On December 24, Royal Decree 1312/2024 was published in the BOE, introducing the Single Registry for Rentals and the Digital Single Window for Rentals. This regulation is designed to improve the management and exchange of data related to short- and mid-term rental contracts and ensure they are used appropriately. The decree will take effect on January 2, with full implementation required by July 1, 2025.

Key Differences Between Long-Term and Short-/Mid-Term Rentals

In Spain, long-term rental contracts are governed by the Urban Leasing Law (Law 29/1994) and are intended for residential use. These contracts provide tenants with security and stability, typically lasting for years. On the other hand, short- and mid-term rental contracts are designed for temporary stays, such as someone coming to Spain for a course, a work project, or a medical procedure. These contracts are intended for non-permanent housing needs and often include fully furnished accommodations with all necessary amenities for temporary use.

The government's focus with this new regulation is to ensure these mid- and short-term contracts are not misused. Specifically, the aim is to prevent landlords from offering temporary contracts to tenants who are actually seeking long-term residential housing, a practice that has caused tension in the rental market. By establishing clear rules and a transparent registry, the government hopes to protect legitimate long-term tenants while maintaining a fair and regulated market for temporary rentals.

Who Is Affected by the Regulation?

This regulation applies primarily to short-term rentals that are not covered under Article 2 of the Urban Leasing Law. These include rentals for temporary purposes such as vacations, work assignments, studies, or medical treatments. Properties rented under these terms must be properly furnished and equipped for temporary use.

Notably, the regulation excludes hotels, aparthotels, campsites, caravan parks, and similar accommodations. These types of properties are not required to register in the Single Window for Rentals.

The New Obligations for Landlords

Landlords offering short- or mid-term rentals must now register each property in the Digital Single Window. They will also need to obtain a unique registration number for each property or unit being rented and provide this information to online platforms offering their property. Additionally, landlords will be required to supply information about their rentals to the authorities to ensure compliance with the regulation.

While the regulation focuses on the proper registration and transparency of temporary rentals, it does not govern aspects such as the reasons or documentation required to justify a mid-term contract. However, this measure ensures that rental contracts align with their intended use, protecting both tenants and landlords from potential misuse.
